1. Scope
These Terms of Sale govern all purchases made on getnuvala.com ("the Site"), operated by SARL Bastim Group, trading as Nuvala, SIRET 100 506 906 00013, registered office at 60 rue François 1er, 75008 Paris, France. They apply to all customers, regardless of their country of residence, without prejudice to any mandatory consumer protection rules applicable in your country.
By placing an order, you accept these Terms of Sale in full.
2. Products
We make every effort to present our products (photos, descriptions, sizing, materials) as accurately as possible. However, minor variations may occur, particularly due to screen display differences. Products are offered subject to availability.
3. Prices
Prices are displayed on the Site in the currency applicable to your location and include all applicable taxes, unless otherwise stated. Shipping costs are shown separately at checkout before you confirm your order.
We reserve the right to modify our prices at any time. The price applicable to your order is the one displayed at the time you place it, regardless of any subsequent price change.
For orders shipped outside the European Union, including to the United States, additional customs duties or import taxes may apply upon delivery, as detailed in our Shipping Policy.
4. Order Process
To place an order: select your item(s) and size, add them to your cart, provide your delivery and billing information, choose a payment method, and confirm your order.
Your order is considered final once you receive an order confirmation email from us. This confirmation email constitutes acceptance of your order and forms the sales contract between you and SARL Bastim Group.
We reserve the right to cancel or refuse any order in the event of a pricing error, unavailability of the product, or reasonable suspicion of fraud, in which case you will be notified and fully refunded if payment was already taken.
5. Payment
Payment is due in full at the time of order, via the payment methods available on the Site (processed securely through Shopify Payments). By providing your payment details, you confirm that you are authorized to use the selected payment method. Your order will not be processed until payment is confirmed.
6. Delivery
Delivery is governed by our Shipping Policy, which forms an integral part of these Terms of Sale. We currently ship to France, the European Union, and the United States. Estimated delivery times are provided in good faith but are not guaranteed, as they may depend on carriers and, for international orders, customs processing.
Risk of loss or damage to products passes to you upon delivery to the address provided at checkout.
7. Right of Withdrawal and Refunds
You may request a refund within 14 days of receiving your order, in accordance with our Return & Refund Policy, which forms an integral part of these Terms of Sale. As stated in that policy, physical return of the item is not required for refund requests submitted within this period.
8. Legal Warranties
Regardless of the above, all products benefit from the statutory warranty of conformity (Articles L217-3 et seq. of the French Consumer Code) and the warranty against hidden defects (Articles 1641 et seq. of the French Civil Code). If a product is defective or does not conform to your order, contact us at contact@getnuvala.com for a free repair, replacement, or refund.
9. Liability
SARL Bastim Group cannot be held liable for delays or failures in the performance of the sales contract resulting from an event of force majeure, as defined by French law and case law (including, but not limited to, natural disasters, carrier strikes, or customs disruptions).
Our liability is limited to the amount actually paid for the order concerned, except in cases of gross negligence, willful misconduct, or where such limitation is not permitted by applicable law (in particular regarding death or personal injury).
10. Personal Data
Your personal data is processed in accordance with our Privacy Policy, which forms an integral part of these Terms of Sale.
11. Intellectual Property
All content on the Site (text, images, product photography, logos, the Nuvala brand) remains the exclusive property of SARL Bastim Group and may not be reproduced without prior written consent.
12. Applicable Law and Dispute Resolution
These Terms of Sale are governed by French law. In the event of a dispute, EU consumers may use the free mediation service of [MEDIATOR NAME — pending], or the EU Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr. Failing an amicable resolution, disputes shall be submitted to the competent French courts, without prejudice to any mandatory consumer protection rules applicable in your country of residence.
